Abstract
En el trabajo se analizan las distintas posturas doctrinales y jurisprudenciales existentes en materia de responsabilidad concursal, sobre cuál es su naturaleza jurídica: si se trata de una medida resarcitoria o, contrariamente sancionadora; o si, diversamente, atiende a otro tipo de funciones. Y ello, atendiendo a la última reforma concursal de 10 de octubre de 2011, con la incorporación del nuevo art. 172 bis a la Ley Concursal. ABSTRACT In this work, it is analyzed the different doctrinal and jurisprudential points of view in bankruptcy liability, about what it is its legal nature: whether, a kind of compensation or, on the contrary, a legal sanction; or even more, if it attends to other functions. And all of it, attending to the last bankruptcy reform of 10 October 2011, with the addition of the new article 172 bis to the Bankruptcy Law.
