Abstract
Al hilo de la reciente jurisprudencia del Tribunal de Justicia, se aborda el ámbito de aplicación espacial de la legislación europea sobre protección de datos personales, con especial referencia al sometimiento del editor del motor de búsqueda –Google Inc- a la legislación española de protección de datos. También se analizan la caracterización del gestor del motor de búsqueda como responsable del tratamiento, así como las obligaciones del motor de búsqueda y la interacción con la posición de los editores de sitios de Internet. Por último, se aborda el alcance del llamado derecho al olvido y sus implicaciones con respecto a las actividades de los motores de búsqueda.
In the light of the most recent case law of the ECJ, the territorial scope of application of the EU data protection law is discussed, with a special focus on the applicability of EU legislation to Google Inc, as search engine provider. Additionally, the position of the undertaking managing a search engine as data controller, the obligations of the search engine in this respect as well the relationship with the position of the pusblishers of websites are addressed. Finally, the scope of the right of erasure and its consequences on the activities of searc engines are also discussed.
