Abstract
La tesis se propuso examinar el proceso constitucional chileno desde el otorgamiento de la Constitución de 1980 en adelante y el complejo camino que el país ha recorrido, en función de ir reestructurando un código constitucional conforme a los cánones del constitucionalismo democrático, que inspiraron su desarrollo constitucional desde la independencia. En la medida en que el proceso constitucional chileno que arrancó en 1980 sigue abierto, el trabajo buscó abordar, junto a la génesis, carácter y reformas de la Constitución de 1980, de un modo particular, el momento constitucional actual donde se ha puesto en movimiento por el Gobierno, un proceso constituyente destinado a dictar una nueva Constitución . La tesis examina en primer lugar, los aspectos fundamentales de todos los textos constitucionales chilenos anteriores a 1973, concluyendo que el desarrollo constitucional chileno tuvo siempre su inspiración doctrinaria en los principios del constitucionalismo liberal y democrático. Se analiza luego, la constitución de 1980 desde su génesis hasta su contenido normativo, para concluir que comporta un quiebre doctrinario fundamental con el constitucionalismo chileno anterior a 1973, al consagrar un régimen político autoritario, no democrático, de pluralismo restringido, tutelado por las fuerzas armadas. Después de examinar las principales reformas a la Constitución de 1980, se aborda, el momento constitucional actual, proponiendo un arreglo constitucional consensual para una nueva Constitución, que culmine el proceso de conciliar la Constitución chilena de manera plena con los principios de un régimen político democrático, y que se haga cargo de poner al día la norma jurídica en relación a los enormes cambios de la realidad política de las últimas cuatro décadas. La tesis propone que el modo en que este proceso garantice continuidad jurídica y se haga bajo el imperio de la ley, es que se lleve adelante en ejercicio del poder constituyente derivado.
The purpose of this thesis was to analyze the Chilean constitutional process from the granting of the political Constitution of 1980 onwards. The complex path that the country has gone through based on the restructuration of a constitutional code under the canons of a democratic constitutionalism that inspired its constitutional development since the independence itself. To the extent that the Chilean constitutional process that started in 1980 is still open, this work seeks to address the current constitutional moment, where it has been set in motion by the government a constituent process intended to promulgate a new political constitution. The thesis examines, in the first place, the major aspects of all the Chilean constitutional doctrine prior to 1973, concluding that its constitutional development always had its inspiration in the principles of liberal democratic constitutionalism. Secondly, the constitution of 1980 is analyzed, from its genesis to its fundamental normative content, concluding that it involves break with the previous doctrinarian Chilean constitutionalism before 1973, by consecrating a non democratic, authoritarian regime, with a restricted pluralism and protected by the military forces. After an exhaustive look at the main reforms to the constitution of 1980, it was analyzed the current constitutional moment of the country, proposing a consensual constitutional arrangement for a new political Constitution, which would complete the process of reconciling the chilean Constitution fully with the principles of a democratic political regime, updating the legislation to the enormous changes that the political reality has gone through in the last four decades. The thesis suggests for this process to ensure legal continuity and for it to be done under the rule of law, it should be carried out in the performance of a derived constituent power.
