Abstract

Los empleados públicos al servicio de las distintas Administraciones y entidades de naturaleza pública pueden prestar sus servicios en régimen funcionarial, si son funcionarios públicos de cualquier clase, o laboral, si se trata de personal asalariado. Mientras que el personal funcionario se rige fundamentalmente por normas de Derecho Administrativo, el personal laboral lo hace principalmente por el Derecho del Trabajo. No obstante, los empleados públicos que prestan sus servicios en régimen laboral para las distintas Administraciones están sujetos a una serie de particularidades de su régimen jurídico en comparación con los asalariados del sector privado. Es así que el personal asalariado al servicio de las distintas Administraciones públicas se ve afectado por una doble regulación, ya que debe respetar la normativa que se ocupa con carácter general del empleo público, pero también las normas laborales que le resulten de aplicación. Dentro de ese contexto, los empleados públicos en régimen laboral al servicio de las Administraciones de las distintas comunidades autónomas se encuentran en una situación muy particular, pues están vinculados asimismo por las normas de ámbito autonómico. Esta situación es tan peculiar debido, fundamentalmente, a la falta de competencias autonómicas para legislar en materia laboral, pues la Constitución Española las atribuye exclusivamente al Estado. Sin embargo, de la relación entre la Administración como empleadora y el personal asalariado a su servicio deriva la capacidad de las distintas Administraciones autonómicas para ordenar y gestionar sus recursos humanos, algo que, sin lugar a dudas, incide en la relación con su personal laboral...

Public employees in the service of Administrations and public entities may render their services under a civil servant regime, if they are public civil servants of any kind. But other workers can also provide their services under a labor regime. While civil servants are essentially governed by Administrative Law, employees under labor regime mainly do it by Labor Law. However, the legal regime of public employees who provide their services under labor regime for Administrations has several peculiarities in relation to the one of private sector workers. Thus, employees under labor regime working for public Administrations are governed by a double regulation: they are governed by the general rules that govern public employment and, at the same time, by the labor rules that apply to them. In this context, public employees who provide their services under labor regime for the Administrations of the autonomous communities are in a very particular situation, since they are also governed by the rules of the autonomies. This situation is so particular basically because enacting labor laws falls outside the competence of autonomous communities. According to the Spanish Constitution, only the State can enact them. However, the ability of the autonomous Administrations to organize and manage their human resources derives from the relationship between the Administration as an employer and the workers under labor regime at its service. This, undoubtedly, affects the relationship with its employees under labor regime. The title of this doctoral thesis is "The autonomic regulation of the public employment of labor regime". The objective is to examine to what extent the rules approved by the autonomous communities affect, or can affect, the workers under labor regime that provide their services to the autonomous Administrations.
