Abstract
Los términos de la separación del Reino Unido de la Unión Europea en lo relativo a la protección de los derechos de propiedad industrial e intelectual han sido en buena medida ya acordados en el marco del Borrador de Acuerdo de Retirada. Particular atención merecen las previsiones relativas a los derechos unitarios, como las marcas de la Unión y los diseños comunitarios, así como lo relativo al agotamiento de derechos. Al margen del Acuerdo, también ha habido novedades acerca de las perspectivas en relación con el registro de nombres de dominio bajo “.eu”. Además, la ratificación por el Reino Unido del Acuerdo sobre el Tribunal Unificado de Patentes dota de renovado interés a la interacción entre el Brexit y el establecimiento de la patente europea con efecto unitario.
Significant progress has been made concerning the terms of the separation of the United Kingdom as regards the protection of intellectual property after Brexit. Such progress is reflected in the current text of the Draft Agreement on the withdrawal of the United Kingdom from the European Union. Its main provisions concern the implications of Brexit on unitary rights, such as European Union trade marks and Community designs, and issues such as exhaustion of rights. Other recent developments concern the repercussions of Brexit on the EU regulatory framework for the .eu Top Level Domain. Finally, the ratification of the Unified Patent Court Agreement by the United Kingdom poses new challenges regarding the implications of Brexit for the unitary patent.
