Abstract
En el trabajo se pretende abordar el acoso escolar, uno de los problemas más acuciantes de la sociedad de nuestro tiempo, desde la perspectiva de la responsabilidad civil extracontractual. En consecuencia, se estudian en este trabajo los diferentes sistemas de responsabilidad civil aplicables en supuestos de acoso, analizando de forma detallada los dos que se aplican en la inmensa mayoría de los casos: la responsabilidad civil pura y la responsabilidad civil derivada de delito cometido por menor de edad. Ahondaremos en la responsabilidad que tienen, en cada uno de estos sistemas, el propio menor acosador, sus padres y los titulares de los centros docentes en los que estudian. A partir de dicho análisis, se determinará si esta diversidad de sistemas es adecuada o si por el contrario sería recomendable la unificación de todos ellos en un único sistema de responsabilidad civil.
This academic article deals with extracontractual civil liability derived from bullying, one of the most pressing problems in our society. Therefore, the article delves into the different extracontractual liability systems that are applicable to bullying cases. In order to this objective, the article analyses profusely the two most frequent extracontractual liability systems in bullying cases: general extracontractual civil liability and civil liability derived from a criminal offence. In each of them, the article studies the liability of minors that commit bullying, the liability of the parents of that minors and the liability of the owners of the schools where bullying is committed. Through this research, the article will elucidate if this variety of systems is advisable or if, on the contrary, it will be recommendable to unify all of them into a single extracontractual civil liability system.
