Abstract
En este trabajo estudiamos seis figuras jurídicas del Derecho de sucesiones que, desde antes de 1981 y hasta ahora, han sido desarrolladas por el legislador español con la intención de reducir los efectos del riguroso sistema legitimario y así lograr ampliar la libertad testamentaria del causante. En concreto, analizamos el legado de bien indivisible e inoficioso del art. 821 del CC, la mejora en cosa determinada y también inoficiosa del art. 829 del CC, el supuesto de partición especial del art. 1056.2 del CC, el supuesto general de pago de la legítima en metálico extrahereditario contenido en los arts. 841 al 847 del CC, la sustitución fideicomisaria especial reglamentada en los arts. 782, 808.4 y 813.2 del CC, y el derecho de habitación especial del art. 822 del CC. La aplicación de alguno de estos tienen la consecuencia de flexibilizar la vertiente cualitativa del principio de intangibilidad de la legítima, solo en cuanto a la calidad en que se percibe el derecho legitimario. In this dissertation we study six legal figures of the Law of Succession that, since before 1981 and until now, have been developed by the Spanish legislator with the intention of reducing the effects of the rigorous legitimary system and thus achieve extend the testamentary freedom of the deceased. In particular, we analyze the legacy of the indivisible and inofficious good of art. 821 of the CC, the improvement in something determined and also inofficious of art. 829 CC, the special partition assumption of art. 1056.2 of the CC, the general assumption of payment of the legitimate in extra-hereditary cash contained in arts.841 to 847 of the CC, the special trustee substitution regulated in the arts. 782, 808.4 and 813.2 of the CC, and the special housing right of art. 822 of the CC. The application of any of these have the consequence of relaxing the qualitative aspect of the principle of intangibility of the legitimate, only as regards the quality in which the legitimary right is perceived.
