Abstract
En este trabajo realizamos un estudio sobre la construcción y de construcción del derecho al trabajo, en su vertiente individual, desarrollada por el Tribunal Constitucional de España y el Tribunal Supremo de Puerto Rico. En este último caso, tomamos en consideración las expresiones del Tribunal Supremo de los Estados Unidos que resultaban vinculantes para el estado de derecho puertorriqueño. El propósito principal del trabajo fue analizar cómo el derecho al trabajo fue interpretado jurisprudencialmente por ambos tribunales, ello con el objetivo de verificar si los tribunales concernidos han contribuido a lograr o han limitado, a través de sus interpretaciones jurisprudenciales, el máximo de la eficacia del derecho al trabajo constitucionalizado y si eso es cónsono con las expectativas originales de los constituyentes sobre su exigibilidad...
In this work we conducted a study on the construction and deconstruction of the right to work, in its individual aspect, developed by the Constitutional Court of Spain and the Supreme Court of Puerto Rico. In this last case, we took into consideration the expressions of the Supreme Court of the United States of America that were binding on the Puerto Rican state of law. The main purpose of the thesis was to analyze how the right to work was interpreted jurisprudentially by both courts, with the aim of verifying whether the courts concerned have contributed to achieving or limited, through their jurisprudential interpretations, the maximum effectiveness of the constitutionalized right to work and if that is consonant with the original assessments and expectations of the constituents of the Constitutional Convention about their enforceability...
