Abstract
El arbitraje internacional en materia de inversiones, constituye en la actualidad el cauce principal y más utilizado en la solución de controversias legales surgidas entre Estados e inversores privados. La inmensa mayoría de los Tratados de inversión lo contemplan como una garantía inherente a la protección y promoción de la actividad inversora, constituyendo un medio alternativo a los tribunales internos y a la protección diplomática. Sin embargo, a pesar de las ventajas que ofrece, no pueden negarse ciertas dificultades sistémicas y de falta de transparencia, heredadas en gran medida del arbitraje comercial internacional entre sujetos privados. El presente trabajo arroja luz sobre esta problemática y hace un análisis individualizado del modelo y la práctica arbitral en Cuba, realidad muy poco estudiada a pesar de los fuertes vínculos culturales, históricos y económicos que le unen con España. ABSTRACT: The international arbitration on investment, is currently the main and most common used way in the legal disputes arising between private investors and States. The vast majority of investment treaties see it as inherent guarantee for protection and promotion of the investment activity, being an alternative in front of domestic courts and the discretionary diplomatic protection. However the advantages it offers, we shouldn’t ignore the systemic difficulties and lack of transparency, inherited largely from the international commercial arbitration between privates parties. The present study focus on this problem and in addition makes an individualized analysis of the model and arbitration practice in Cuba, an understudied reality, despite the strong cultural, historical and economic factors that bind it to Spain.
