Abstract
En plena expansión del mercado hipotecario, junto a la transparencia e información como sistema de protección del contratante de préstamos y créditos hipotecarios, las reformas legales se orientaron a la agilización y flexibilización de la contratación. Con la crisis del mercado hipotecario, ha cambiado la perspectiva del legislador que ha reforzado los deberes de información y transparencia, junto a la previsión de instrumentos preventivos de la ejecución hipotecaria y una protección específica del consumidor cuando ésta es inevitable. La vigencia de normas dictadas en momentos distintos del mercado hipotecario provoca descoordinación e incoherencia en su aplicación práctica. ABSTRACT: : In a booming mortgage market, along with transparency and information as protection mechanisms of the contractors of loans and mortgages, legal reforms were aimed at speeding up and a more flexible hiring of the mentioned mortgages. With the mortgage crisis the perspective of the legislator has changed, in the sense of strengthening the duties of information and transparency, together with the forecast of preventive tools related to foreclosure and a specific protection of consumers when this one is unavoidable. The validity of regulations issued at different times of the mortgage market causes an uncoordinated and incoherent practical application of these norms.
