Abstract
La presente tesis se centra en el estudio de la documentación aplicada a la traducción jurídica y a la mediación cultural con el fin de dar respuesta a dos problemas detectados principalmente en la práctica profesional de los traductores: en primer lugar, la falta de dedicación o de valoración de la fase documental del proceso traductor, y en segundo lugar, la insuficiente concepción de la traducción como un ejercicio de mediación entre culturas. De este modo, este trabajo pretende resaltar la necesidad de una eficiente fase documental en la que se utilicen correctamente criterios documentales de búsqueda, selección, contrastación y clasificación de fuentes para traducir textos jurídicos que por su naturaleza y su inclusión en un ordenamiento jurídico particular tienen unas características específicas. A su vez, se justificará la mediación cultural en la traducción y se expondrán ejemplos de casos de multiculturalidad y multilingüismo. Con el fin de llevar a la práctica y mejorar estos conocimientos teóricos, realizamos un repertorio bibliográfico multilingüe, accesible impreso u online, centrado en la traducción jurídica con más de setecientas fuentes que sirve como herramienta de trabajo útil y actualizada para los profesionales del área. Todo esto permitirá una mejor formación documental de los traductores del ámbito jurídico y una mayor concienciación de la importancia de la aplicación de las fuentes de información.
The objective of this doctoral thesis is to address a problem specific to the field of translation that is deeply rooted in the field of documentation: the relative lack of importance placed on the documentation phase of the translation process, particularly where legal translations are concerned. It should be noted that such translations, by their nature, are likely to have greater documentation needs. This problem has been demonstrated in professional practice as well as in Master's studies in documentation. It has also been observed that translators are not fully aware of the exercise of cultural mediation that must be carried out when translating, especially in court translation and in the public service. While this may be the case, it cannot be argued that translators do not have specific training in documentation: BAs in Translation and Interpretation throughout Spain must officially include applied documentation studies. Legal translation has greater documentation needs than other types of specialized translations, such as technical or scientific, because its subjects transcend national borders. However, due to the fact that legal terminology is only understood within a legal system or family, it can be considered a second language from a translation perspective. When translating a legal text into another language, this text is linked to a legal system, a legal tradition, a certain style and format, etc. Documentation has been identified as a key element in decoding the message and translating it in the most suitable way because it provides the translator with the necessary tools to perfectly understand a given text and find the most appropriate equivalents. Although translators claim to be aware of the intercultural exercise that is translation, they do not explore theories other than those of equivalence and do not use documentation sufficiently to address cultural problems or to practise translation in the public service, particularly in judicial institutions where cultural aspects of language are more relevant...
