Abstract
A la actuación temprana prevista para aquellas Entidades de crédito que se encuentran en una situación crítica pero leve, le sigue en la Ley, la reestructuración. Esta se configura como un procedimiento intermedio para aquellas Entidades insuficientemente capitalizadas pero viables. Este estadio intermedio constituye una particularidad del régimen español ya que en otros Ordenamientos, por lo general y a excepción de la Ley alemana a la que me referiré en el trabajo, se contemplan únicamente dos regímenes: la actuación temprana y la resolución. En términos generales, y por lo que se refiere a la regulación española del procedimiento de reestructuración, debemos hacer una primera crítica -derivada, probablemente, de la urgencia con que hubo de aprobarse la norma- en relación con la descoordinación de muchos de sus preceptos. Se trata de una regulación a todas luces técnicamente deficiente.
