Abstract
The interaction between the members of one society involves disputes that can be solved by means of Law what it means that in each dispute there are at least two versions of the same history and there is only one version that it is truer than the other. To prove his own truth the lawyer must not know only the courtroom regulations but, furthermore, he or she must know how to use the language strategically to convince the judge that his point of view of the facts is truer than the point of view of the contrary. This does not mean at all that the lawyers use the language in a wrong way, but that is to say if they become more conscious of the way the use it, they will have more chances to win the case. In this sense, the final aim of this study is to show that Law and Language are two realities closely linked, whereas the main purpose is to investigate the courtroom discourse from a communicative, a linguistic and an argumentative perspective, a new and different approach that is used by those works interested on the courtroom discourse. On the one hand, we also want to demonstrate that the lawyers unconsciously use several rhetoric and pragmatic strategies to prove that the contrary is lying and to harm his public self-image in order to convince the judge that the accused is guilty or not guilty of committing a crime. On the other hand, we show that the defense lawyer is the participant that is clearly at a disadvantage from the beginning of the lawsuit wherefore he or she prepares more consciously his action. In order to carry out this study, we analyze some of well-known syntactic and pragmatic theories in order to set up a new analytic model that combine all of them and we apply it to a corpus of real and complete trial texts heard by the Jutjats Penals of Barcelona1 between February 2009 and June 2010 to conclude whether our assumptions are true.
