Abstract
La tecnología disponible en la sociedad de la información ha impactado en profundidad en el sector de la industria musical, modificando la cadena de valor de la explotación de las interpretaciones de los artistas grabadas en fonogramas. Desde la fase de grabación y generación de contenidos, pasando por el desarrollo promocional y comercial del artista y los fonogramas, hasta la comercialización de los mismos, los distintos procesos en cada una de estas etapas, se han servido de las herramientas aportadas por el desarrollo tecnológico y, al mismo tiempo, han debido adaptarse a la nueva realidad. Tal evolución, de avance progresivo y constante hasta nuestros días, está desplegando todo su potencial con la aportación de la interactividad a los distintos vectores de la creación, producción y explotación. El público ha dejado de ser un receptor pasivo y adquiere protagonismo, en mayor o menor medida, en todos los eslabones de la cadena y, principalmente, en el de la explotación. En la era digital, las modalidades de comercialización de las grabaciones a través de su distribución y comunicación pública, se ven complementadas y actualizadas por la puesta a disposición de los fonogramas y los múltiples modelos de negocio que el ejercicio de tal derecho permite desarrollar: descargas, streaming, radios personalizadas, podcastings, videos a la carta, asociaciones comerciales con distintos productos, servicios en la nube, y un largo etcétera, al que hay que sumar todo tipo de posibilidades mixtas derivadas de la conjunción de unos y otros, que son ya realidad y las que aún están por llegar. A lo largo de estas páginas, se identifican y analizan, desde una perspectiva jurídica, los derechos de propiedad intelectual relevantes para la explotación de los fonogramas en el entorno de mercado generado por las tecnologías de la sociedad de la información.
This thesis aims to analyze how information society technologies impact the legal market of the use of phonograms and the intellectual property rights derived thereof. The paper focuses on the phonogram as the object of intellectual property rights, and to that end it intends to study the said rights from the perspective of the producer of phonograms as the owner of these rights. In order to make the assessment as comprehensive as possible, the entire value chain of the music industry is traced from beginning to end, i.e. from the generation of the phonogram to its consumption by the public. By tracing the process, the paper analyzes the fundamental aspects that affect the recognition of the intellectual property rights of the producer of phonograms and their implementation in the different methods of exploitation that exist in the digital era, focusing on the potential obstacles and advantages that may appear when the business models that serve as a channel for said commercialization need to contend with the applicable legislation. The analysis builds on the background information, which establishes the scope of the study and presents the fundamental aspects to be discussed, anticipating some of the issues that will be developed in the paper. Chapter I describes and analyzes specific basic concepts that are frequently used in this sector: phonogram, producer, communication to the public, making available, reproduction, audience, links, search engines, etc. A sound description of these concepts will require the identification of both the rights that bind them and the applicable legal framework. The main rights that are of interest when analyzing the use of phonograms are classified in chapter III according to the level of interaction they contribute to the communication, whether this is none at all (communication to the public) or total (making available).
