Abstract
La presente investigación se deriva del interés por analizar la reforma que en el 2001, la legislatura del Estado de Michoacán –México– llevó a cabo al Código Penal local, introduciendo el tipo penal de violencia familiar, a la luz de la experiencia jurídica española. Dicha refoma tuvo por objeto la protección del “orden familiar” y, además, se complementó con una serie de modificaciones legislativas en la normativa civil y familiar michoacanas. La descripción de la conducta típica, las consecuencias jurídicas, así como la confluencia con otros ámbitos jurídicos normativos que también pretenden combatir la violencia familiar plantean la duda de si la regulación punitiva de dicho fenómeno se corresponde al principio de mínima intervención del derecho penal. De esta manera, se procedió a tomar como punto de partida la delimitación del concepto de familia, pues el fenómeno de la violencia familiar tiene lugar, precisamente, en este núcleo comunitario. Conceptualmente, la familia se ha nutrido de variadas perspectivas, siendo las más importantes la etimológica, la doctrinal, la sociológica y, por supuesto, la jurídica. La descripción de sus orígenes y las diversas etapas por las que evolucionó la familia conduce a la estructura monogámica actual, cuya conformación está condicionada por sus diversas fuentes, esto es, el matrimonio, el concubinato, la filiación, la adopción y el parentesco. De igual manera, se consideró relevante para el desarrollo de la investigación la conceptualización de la violencia familiar y su distinción de la violencia de género y la de naturaleza doméstica, así como las causas de este fenómeno, desgraciadamente extendido en el mundo actual...
This research derives from an interest in analyzing the 2001 reform that the legislature of the State of Michoacan –Mexico– through which the local Penal Code was modified introducing the crime of domestic violence, in the light of the Spanish legal experience. Such penal reform aimed at protecting the "family order" and, moreover, was supplemented by a series of legislative changes in both Michoacan civil and family law. The description of the typical behavior, the legal consequences, as well as the confluence with other regulatory areas that are also intended to combat domestic violence, raises the question of whether punitive regulation of this phenomenon corresponds to the principle of minimum intervention of criminal law. In this way, we proceeded to take as starting point the definition of the concept of family, as the phenomenon of domestic violence occurs precisely within this basic social community. From a conceptual perspective, the family has been the object of various fields, being the most important the etymological, the doctrinal, the sociological and, of course, the legal. The description of its origins and its evolution leads to consider the family in its current monogamous structure, whose formation is conditioned by their different sources, id est, marriage, cohabitation, filiation, adoption and kinship. Similarly, it was considered important for the development of the research the conceptualization of family violence and their distinction from gender violence and domestic violence, and the causes of such phenomenon, unfortunately widespread in today's world. The worldwide expansion of this phenomenon, motivated, first from the feminist movement and human rights perspective, and then out of the concern to protect both minors and disabled persons (including older persons) motivates the emergence, gradually but progressively, of a human right to a life free of domestic violence...
