Abstract
El objeto del presente trabajo consiste en un análisis de todas las cuestiones que afectan a la nueva disciplina que surge con la Ley Concursal, denominada Derecho Concursal Laboral. Se distribuyen las materias en cinco bloques. En el primer bloque, se examinan las competencias laborales del Juez del Concurso, a saber, el despido colectivo, la suspensión de relaciones laborales, la reducción temporal de la jornada de trabajo, la modificación sustancial de las condiciones de trabajo, el traslado colectivo y la extinción del contrato por voluntad del trabajador. Asimismo, se exponen, de un lado, el tratamiento del personal de alta dirección y, de otro, las peculiaridades del descuelgue del Convenio Colectivo, en el concurso. En el segundo bloque, se aborda el estudio del procedimiento concursal de regulación de empleo. El tercer bloque se refiere a los efectos de la declaración de concurso, en las acciones individuales entabladas por los trabajadores ante el orden jurisdiccional social. El cuarto bloque trata de la protección de los créditos laborales y de la Seguridad Social en el concurso, distinguiendo en estos últimos, entre los créditos públicos de la Seguridad Social y, los créditos a favor de los beneficiarios de la Seguridad Social. Y el quinto bloque contiene otras cuestiones que inciden en el Derecho Concursal Laboral, como la transmisión de la unidad productiva autónoma en la fase de liquidación y la sucesión de empresa; la posición del Fondo de Garantía Salarial en el concurso de acreedores; la incidencia del acuerdo extrajudicial de pagos en el ámbito laboral; y, la segunda oportunidad del empresario persona física. The purpose of this work is an analysis of all the issues affecting the new discipline that comes with the Bankruptcy Act, named Laboral Bankruptcy Law. The materials are distributed in five blocks. In the first block, the work skills of the bankruptcy judge, namely the collective dismissal, suspension of labor relations, the temporary reduction of the working day, the substantial change in working conditions, collective transportation and examined termination of the contract by the will of the worker. It also exposed the one hand, the treatment of senior management and on the other, lift the peculiarities of the Collective Agreement, in the contest. In the second part, the study of the bankruptcy procedure of employment regulation is discussed. The third section refers to the effects of the insolvency, in individual actions brought by workers against social jurisdiction. The fourth section deals with the protection of workers' claims and Social Security in the contest, the latter distinguishing between public social security credits and credits for recipients of Social Security. And the fifth block contains other issues that affect the laboral Bankruptcy Law, as the transmission of the autonomous productive unit in the liquidation and business succession; the position of the Wage Guarantee Fund in the bankruptcy; the impact of the settlement of payments in the workplace; and, the second time the individual entrepreneur. All these subjects are approached from a very practical perspective, examining the fundamental issues raised by the application of the Bankruptcy Act, - made with and of the labor law, which have been highlighted by the scientific and judicial doctrine...
