La acción de inconstitucionalidad en Colombia: ¿puede la corte constitucional establecer límites al ejercicio ciudadano de esta acción?

Abstract
La presente tesis doctoral aborda el estudio de la acción de inconstitucionalidad en Colombia, la cual existe de manera ininterrumpida desde 1910, lo que significa que en este país se hacía control de constitucionalidad abstracto 10 años antes que se creara el Tribunal Constitucional Austriaco y 19 años antes de que Kelsen publicase su obra la Garantía Jurisdiccional de la Constitución y la teoría del legislador negativo. En Colombia el titular de la acción es el ciudadano, pero la Corte Constitucional ha venido limitando su acceso, estableciendo por vía jurisprudencial requisitos no contenidos ni en la Constitución ni en la ley. Se hace necesario definir que es la acción de inconstitucionalidad colombiana para luego determinar si el Tribunal Constitucional puede o no limitar su ejercicio. Se pudo concluir que la acción de inconstitucionalidad es en Colombia un derecho humano fundamental, un mecanismo de protección de derechos fundamentales y un mecanismo de participación ciudadana y que no puede la Corte Constitucional de manera arbitraria menoscabar derechos y garantías de esta índole.
The present doctoral dissertation focuses on the study of the action of unconstitutionality in Colombia, which exists uninterruptedly since 1910, this means that the abstract constitutionality control in this country was already implemented 10 years earlier than the Austrian Constitutional Court and was created 19 years before Kelsen published his book The jurisdictional Guarantee of The Constitution and The theory of Negative Legislator. In Colombia the owner of this action is the citizen, but the Constitutional Court has limited their access through jurisprudence by establishing requirements not contained in either the Constitution or the law. It is necessary to define what is the action of the Colombian unconstitutionality and then determine if the Constitutional Court may limit the exercise of the citizen or not. It can be concluded that the action of unconstitutionality in Colombia is a fundamental human right and a means of protection of fundamental rights, also it works as a mechanism for citizen participation and the Constitutional Court can not arbitrarily diminishing rights and guarantees of this nature.
