Abstract
La situación de los pueblos indígenas en Colombia refleja la discrepancia que existe entre un marco constitucional y jurisprudencial avanzado en el reconocimiento de derechos colectivos a los grupos originarios, su escaso desarrollo a nivel legal y reglamentario, y la evidente incapacidad institucional para lograr su implementación y garantía; todo en el contexto de un conflicto armado interno en el que la actividad de los múltiples actores que intervienen en él, dificultan las posibilidades de acción estatal, así como los ejercicios de autonomía y participación de estos grupos.Por estos motivos, los pueblos indígenas de Colombia están particularmente indefensos y expuestos al conflicto armado y a sus consecuencias, al igual que al abuso de aquellos interesados en explotar los recursos naturales que se encuentran en sus tierras y territorios ancestrales, sobre la base de situaciones estructurales preexistentes de pobreza extrema y abandono institucional, que operan como factores catalizadores de las profundas y sistemáticas violaciones de los derechos humanos a las que se ven sometidos...
The situation of the indigenous communities in Colombia reflects the current discrepancy between three main factors: a) An advanced Constitutional and Jurisprudential framework in the recognition of the collective rights for the native groups; b) The scarce development and regulation of such framework; and c) The evident incapability from the government to implement and guarantee it. All this contained in an internal armed conflict in which the activities of the multiple agents that participate, make difficult any possible State action as well as the autonomy and participation of those groups.These are the reasons why the Colombian indigenous communities are unprotected, exposed to the armed conflict, and its consequences, and also to the abuse of those whose interests are to exploit the natural resources found in their lands and their ancient territories.
