Abstract
Este trabajo lleva a cabo una medición de las restricciones de la libertad de contratación en cinco contratos paradigmáticos relacionados con las justificaciones que tradicionalmente se han esgrimido para limitar la misma: la prohibición de acuerdos colusorios y la reserva de actividad limitan la libertad de contratación por razones que tienen que ver con fallos del mercado; la normativa laboral, que restringe la libertad delas partes para pactar sin restricciones las condiciones de trabajo, tiene su origen en argumentos redistributivos; la prohibición de vender drogas tóxicas es consecuencia dela limitación de actividades consideradas ilegales; y la prohibición de intercambiar sexo por dinero está basada en razones de índole moral. A lo largo del trabajo se ha estudiado la normativa que restringe la libertad de contratos, haciendo especial hincapié en el caso español, y se han investigado las consecuencias, desde el punto de vista del análisis económico, que tal limitación genera en los mercados. El objetivo principal, por tanto,es analizar la medición de las restricciones a la libertad de contratación y sus efectos y conocer si la limitación está realmente justificada y cumple con los objetivos por la que se estableció. Se demostrará que existe un voluminoso cuerpo de trabajos científicos e investigaciones que evidencian las conclusiones presentadas. Para ello se han estudiado pormenorizadamente 140 artículos científicos y 33 monografías especializadas; se han utilizado 29 bases de datos estadísticas; se han recuperado y examinado más de 120 noticias publicadas en distintos medios; se han estudiado cerca de 100 normas y alrededor de 25 sentencias; y se han analizado más de 135 informes técnicos, estudios y publicaciones oficiales, cotejando sus resultados y estableciendo las posibles relaciones con la normativa que limita la libertad de contratación...
This dissertation accomplish a measurement of the restrictions of freedom of contract in five paradigmatic contracts related to the justifications that, traditionally, have been used to limit freedom of contract: the prohibition of collusive agreements and the reserve of activities limit the freedom of contract for reasons related with market failures; labor regulations, which restrict the freedom of the parties to negotiate labor conditions, have their origin in redistributive arguments; the prohibition of selling toxic drugs is a consequence of the limitation of activities considered illegal; and the prohibition of exchanging sex for money is based on moral reasons. Throughout this dissertation the regulation that restricts the freedom of contract has been studied, with special emphasis on the Spanish case, and the consequences, from an economic point of view, that this limitation causes in the markets have been investigated. The main objective is to analyze the measurement of restrictions on freedom of contract and its effects to find out if the restraint is really justified and it achieves the purposes for which it was established. It will be shown that there is a voluminous body of scientific work and research that evidences the conclusions. For this purpose, 140 scientific articles and 33 specialized monographs have been studied in detail; 29 statistical databases have been used; more than 120 news published in different media have been recovered and examined; nearly 100 laws and about 25 sentences have been studied; and more than 135 technical reports, studies and official publications have been analyzed, comparing their results and establishing possible relationships with the regulations that limit freedom of contract...
