Abstract
El presente trabajo ha tenido por finalidad, conseguir y analizar información legislativa, jurisprudencial y doctrinal, relativa al proceso histórico y actual sobre el grado de libertad de testar que ha existido desde el Derecho romano hasta nuestros días, así como proponer soluciones para ampliarla. Para ello, en primer lugar, comentamos, de forma breve, el grado de libertad de testar que ha existido desde el primitivo Derecho romano hasta la época codificadora de 1889 y, en segundo lugar, desde ésta hasta nuestros días, en la que ya la relacionaremos con el sistema legitimario existente y, sobre todo, quienes son las personas con derecho a percibir la legítima, es decir, los legitimarios...
