Abstract
El recurso de casación directo o per saltum es aquel que se interpone de forma inmediata frente a sentencias dictadas en primera instancia. El trabajo tiene como finalidad hacer un análisis histórico del recurso de casación directo en la LEC 1881 y un estudio de Derecho comparado entre el ordenamiento español y alemán. Además, se examina desde una perspectiva de lege ferenda la oportunidad de reintroducir esta modalidad de recurso extraordinario en nuestro ordenamiento y la regulación que mejor se adaptaría al sistema.
The direct appeal or appeal per saltum is that which is filed immediately against judgments issue in the first instance. This paper make a historical analysis of the appeal per saltum in the LEC 1881 and a compared study between the Spanish and German legal order. In addition, it examines from a lex ferenda perspective the opportunity to reintroduce this type of appeal and the regulation that would best suit the system.
