Abstract
La pandemia provocada por la COVID-19 y la rápida expansión del teletrabajo en la sociedad española explican la adopción del Real Decreto-ley 28/2020, de 22 de septiembre, de trabajo a distancia. En este contexto, el presente Trabajo de Fin de Grado pretende realizar un análisis del régimen jurídico del teletrabajo tanto antes como después de la aprobación del RDL 28/2020, haciendo una especial alusión a la negociación colectiva. Se comienza estudiando las primeras regulaciones del teletrabajo en España, el Convenio nº 177 OIT sobre el trabajo a domicilio, el Acuerdo Marco Europeo sobre el Teletrabajo y el art. 13 del Estatuto tras la reforma operada por la Ley 3/2012, poniendo de relieve el escaso tratamiento convencional de esta materia. Posteriormente se procede a un análisis del régimen jurídico resultante del RDL 28/2020, abordando sus principales aspectos de la mano de los primeros convenios colectivos publicados tras la entrada en vigor de la Ley del Trabajo a distancia. Finalmente, se examina el papel que debe y deberá desempeñar la negociación colectiva. El TFG viene acompañado de un Anexo en donde se analizan veintiséis convenios colectivos de diferentes fechas, sectores y empresas que sirve para testar el estado de la negociación colectiva en materia de teletrabajo.
La pandémie provoquée par la COVID-19 et la rapide expansion du télétravail dans la société espagnole expliquent l'adoption du Décret-loi 28/2020, du 22 septembre,de travail à distance. Dans ce contexte, le présent Projet de fin d'études entend réaliser une analyse du régime juridique du télétravail, avant et après l'approbation du Décret-loi, faisant une mention spéciale à la négociation collective. Tout d'abord, seront étudiées les premières régulations du télétravail en Espagne, la Convention nº 177 OIT sur le travail à domicile, l'Accord-cadre européen sur le télétravail et l'art 13 du Statut des travailleurs après la réforme introduite par la Loi 3/2012, soulignant le traitement limité de cette matière par les conventions collectives. Par la suite, le régime juridique issu du Décret-loi 28/2020 sera analysé, en abordant ses aspects principaux assorti d'un examen des premières conventions collectives publiées après l'entrée en vigueur de la Loi du Travail à distance. Finalement, il sera question d'envisager le rôle qui doit et devra jouer la négociation collective. Le Projet de fin d'études comprend aussi une annexe dans laquelle sont retracées vingt-six conventions collectives de différentes dates, branches et entreprises qui permettent de rendre compte de l'état actual de la négociation collective dnas le domaine du télétravail.
The current outbreak of COVID-19 and the fast spread of teleworking in Spanish society explain the passing of the Royal Decree-law No. 28/2020, 22th September, about telecommuting. In this context, the present Final degree projet intends to carry out a study of teleworking legal framework before and after the adoption of the Royal Decree-law No. 28/2020, with a special reference to collective bargaining. In the beginning, the first regulations of telecommuting in Spain, the Homework Convention 1996 (No. 177), the European Framework of Agreement on Telework and the Article 13 of the Workers' Statute introduced by the Law No. 3/2012 are studied in order to highlight the limited treatment ot the matter by collective bargaining. Subsequently, the new legal status of teleworking is analyzed with a global approach of its main aspects, as well as a consideration of the early collective agreements published after the passing of the Royal Decree-law No. 28/2020. Finally, it is examined the role that collective bargaining should play in the future. This project is accompanied by an attachment where collective agreements from different dates, sectors and businesses ares studied to test the current state of the collective bargaining in the area of telecommuting.
