Abstract
El presente estudio ofrece una aproximación al contenido y los presupuestos de los acuerdos de refinanciación desde la perspectiva del Texto Refundido de la Ley Concursal. Asimismo, se distinguen los distintos grupos de acuerdos de refinanciación y sus características y con más detalle, se abordan las distintas clases de acreedores determinantes para aprobar y homologar un acuerdo, y en especial aquella que conforma el pasivo financiero. Igualmente, se realiza un breve análisis en materia preconcursal establecida en el reciente Anteproyecto de la reforma de la Ley Concursal sobre los marcos de reestructuración y en la propuesta de la Directiva UE 2019/1023.

This study offers an approach to the content and assumptions of refinancing agreements from the perspective of the Consolidated Text of the Insolvency Act. In addition, this paper distinguishes between the different groups of refinancing agreements and their characteristics and, in more detail, deals with the different types of creditors that are decisive for the approval and homologation of an agreement, and in particular those that make up the financial liabilities. Finally, the study also includes a brief analysis of pre-bankruptcy matters established in the recent draft reform of the Bankruptcy Law on restructuring frameworks and in the proposed EU Directive 2019/1023.
