Abstract
La sentencia de 5-V-2020 del Tribunal Constitucional Federal alemán destaca la necesidad de emprender reformas en el futuro. Tanto la proclamación de una Constitución europea como la unificación de la política fiscal son medidas a largo plazo que actualmente parecen difíciles de implantar. Considerando el perjuicio que supone para la primacía del Derecho de la Unión que un Tribunal de un Estado miembro declare que una sentencia del Tribunal de Justicia de la Unión Europea es un acto ultra vires, se plantea la conveniencia de renovar el trámite de la cuestión preliminar ante el Tribunal de Justicia, dando más audiencia al Estado en cuestión, y más ampliamente con decisiones más motivadas. Los Estados miembros tienen la responsabilidad de participar en los integración, vigilando también el cumplimiento de los Tratados. Para ello, el control de la identidad constitucional de cada Estado, parece más adecuado que el control ultra vires
The judgment of 5-V-2020 of the German Federal Constitutional Court highlights the need to undertake reforms in the future. Both the proclamation of a European Constitution and the unification of fiscal policy are long-term measures that currently seem difficult to introduce. Considering the injury that supposes for the primacy of Union Law that a Constitutional Court of a Member State declares a judgment of the European Court of Justice ultra vires, it raises the advisability of renewing the procedure of the preliminary question before the European Court of Justice, giving more audience to the concerned State, and more widely motivating decisions. Member States have the responsibility to participate in European integration, also monitoring compliance with the treaties, for this, through control of the constitutional identity of each State, it seems more suitable than that of ultra vires control
