Abstract
Este estudio presenta una perspectiva de la docencia de la Religión como un derecho de los estudiantes a acceder a la cultura y a participar de la vida cultural. Este nuevo título supone un cambio de perspectiva (hasta ahora se ha insistido en el derecho de los padres a elegir para sus hijos la educación religiosa y moral que esté de acuerdo con sus propias convicciones), no excluye que pueda impartirse también en condiciones equiparables a las demás asignaturas fundamentales, en la que se transmiten conocimientos científicos. El desarrollo del acceso a la cultura manifiesta la triple vertiente de la clase de religión en la escuela: transmisión de valores, de conocimientos y de cultura. Estas propuestas se fundamentan en la jurisprudencia del Tribunal Supremo y Constitucional español y en la jurisprudencia del Tribunal Europeo de Derechos Humanos

This study presents a perspective of the teaching of Religion as a right of students to access culture and to participate in cultural life. this new title supposes a change of perspective (until now the right of parents to choose religious and moral education for their children in accordance with their own convictions), not excludes that it can also be taught in conditions comparable to other subjects fundamental, in which scientific knowledge is transmitted. The development of access to culture manifests the triple aspect of the religion class at school: transmission of values, knowledge and culture. These proposals are based on the jurisprudence of the Court Spanish Supreme and Constitutional Court and in the jurisprudence of the European Court of Human Rights Humans
