Abstract
Los desarrollos tecnológicos en los campos de la informática, la robótica y la biotecnología van a provocar la aparición de nuevos tipos de organismos, los denominados transhumanos y posthumanos. Estos nuevos organismos pueden tener naturalezas muy diferentes, pero en cualquier caso su aparición va a provocar un replanteamiento del concepto de Derechos Humanos. En este trabajo, mediante una revisión bibliográfica de artículos científicos, libros, revistas y legislación, se realiza un análisis del concepto y evolución generacional de los Derechos Humanos y se expone el estado actual de desarrollo en los campos de la informática, la robótica y la biotecnología, destacando aquellos avances que más probabilidades tienen de contribuir a la aparición de los transhumanos y los posthumanos. Tras dicho análisis se realiza una investigación jurídica en la que se explora, en primer lugar, cuáles son las características mínimas que debe tener un organismo para tener Derechos Humanos, y después se explica por qué la cuarta generación de Derechos Humanos deberá estar orientada tanto a la defensa del ser humano como especie como al derecho a ser posthumano. Por último, se explora la posibilidad de que los posthumanos tengan derechos exclusivos, y se deja planteada la cuestión de los Derechos Humanos de las Inteligencias Artificiales.

Technological developments in the fields of computing, robotics and biotechnology will lead to the emergence of new types of organisms, the so-called transhumans and posthumans. These new organisms may have very different natures, but in any case their emergence will lead to a rethinking of the concept of Human Rights. In this paper, through a bibliographic review of scientific articles, books, journals and legislation, an analysis is made of the concept and generational evolution of Human Rights and the current state of development in the fields of computer science, robotics and biotechnology is presented, highlighting those advances that are most likely to contribute to the emergence of transhumans and posthumans. This analysis is followed by legal research which explores, firstly, what are the minimum characteristics that an organism must have in order to have Human Rights, and then it is explained why the fourth generation of Human Rights should be oriented towards both the defence of the human being as a species and the right to be posthuman. Finally, the possibility of posthumans having exclusive rights is explored, and the question of the Human Rights of Artificial Intelligences is raised.
