Abstract
Análisis de la jurisprudencia del Tribunal de Justicia acerca de la interpretación del artículo 8.2 del Reglamento Roma II relativo a la determinación de la ley aplicable a la infracción de un derecho de propiedad intelectual unitario. Se valora la contribución de la reciente sentencia del Tribunal de Justicia en el asunto Acacia, a la luz de su jurisprudencia previa, y su interacción con la interpretación de las normas de competencia judicial internacional en este sector. La respuesta del Tribunal se funda en los objetivos de seguridad jurídica y de previsibilidad del RRII y pese a presentar importantes virtudes, puede introducir también nuevos elementos de distorsión.

The case law of the Court of Justice of the EU on the interpretation of Article 8.2 of the Rome II Regulation on the law applicable to non-contractual obligations arising from an infringement of a unitary Community intellectual property right is discussed. In the light of the previous case-law, particular attention is given to the recent judgment in Acacia and its interplay with the interpretation of the jurisdiction rules in this area. The approach adopted by the Court is intended to fulfil the objectives of legal certainty and predictability. Although such an approach represents a progress from that perspective, it raises also some additional challenges.
