Abstract
El impacto de la tecnología y la digitalización en el mundo laboral ha dado lugar a nuevas cuestiones que el derecho debe abordar y dar respuesta. En este contexto, el presente trabajo tiene por objeto realizar un análisis del derecho a la desconexión digital, configurándolo como un límite entre el ámbito personal y laboral, en aras a proteger la conciliación de la vida personal y laboral, el descanso del trabajador, así como evitar la multitud de riesgos psicosociales que provoca la hiperconectividad en la salud de los trabajadores. En este sentido, los trabajadores deben tener garantizado el derecho a no responder cualquier tipo de comunicación por parte de la empresa fuera del tiempo de trabajo, así como el respeto de su intimidad personal y familiar, sin miedo a sufrir repercusiones por parte del empresario. La normativa española regula este derecho en el artículo 88 de la Ley Orgánica de Protección de Datos Personales y garantía de los derechos digitales y en el artículo 18 de la Ley de trabajo a distancia, remitiendo su desarrollo a la negociación colectiva.
The impact of technology and digitization in the workplace is a subject that has given rise to new questions. The law must tackle them and try to give a response. In this context, the purpose of this essay is to analyse the right to discconect, configuring it as a limit between the personal área and the workplace, in order to protect the balance of personal and worklife, the resto of the worker and try to avoid multiple psycosocial risks that the hyperconnectivity cause in workers health. In this sense, work must have guarantee the right not to attend any type of communication from the company out work time and respet personal and familiar privacy, without fear to suffer repercussions from the employer. The spanish regulation develop this right in the article 88 of the personal data protection law and in article 18 of remote work law, sending its development to the collective bargaining.
