Abstract
Esta tesis doctoral tiene como objetivo efectuar un estudio acerca de uno de los instrumentos de control del Gobierno de que dispone la Cámara de Diputados de Chile, como son las Comisiones especiales investigadoras; en particular, de las facultades que tienen para requerir la presencia de determinadas personas y de solicitar los documentos e informaciones que se estimen necesarios para el desarrollo de la investigación. Para tales efectos se realiza un análisis teórico y práctico con miras a determinar la cohesión o colisión entre los dos planos del quehacer parlamentario, además de ejecutar un estudio comparado con la normativa vigente en otros países, en especial con España, cuya finalidad es explorar herramientas que permitan potenciar las funciones de control que se materializan a través de esta institución. Se resalta que las Comisiones especiales investigadoras son un instrumento de enorme trascendencia para el control de la acción del Gobierno y que la normativa existente en Chile en materia de comparecencia y acceso a la información puede y debe ser perfeccionada para que ellas cumplan eficazmente su objetivo. Al final de la investigación, junto a las conclusiones de la misma, se realizan propuestas para mejorar la normativa vigente en la materia.
This doctoral thesis aims to carry out a study on one of the oversight instruments to control governmental acts that are available for the Chamber of Deputies of Chile, such as the special investigative Commissions or Parliamentary Investigation Commission; in particular, of the powers they have to require the attendance of certain individuals and to request the documents and information deemed necessary for the development of the investigation. For such purposes, a theoretical and practical analysis is carried out with a view to determining the cohesion or collision between the two levels of parliamentary work, in addition to executing a compared study of the regulations in other countries, especially Spain. The objective of this study is to explore tools that allow strengthening the control acts that are materialized through this institution. It is emphasized that the Special Investigative Commissions are an instrument of enormous importance for the oversight of the Government's action, and that the existing regulations in Chile, regarding appearance and access to information, must be improved to effectively fulfill their objective. At the end of the investigation, together with its conclusions, proposals are made to enhance the current regulations on the matter.
