Abstract
El precedente judicial desempeña un papel importante en el common law y a través del trabajo realizado por los Tribunales se comprueba que las decisiones judiciales fueron respetadas desde el inicio como forma de desenvolvimiento de la igualdad y la justicia. Su utilización contribuye para optimizar un sistema coherente y estable. Se destaca el valor de la argumentación, principalmente a través del stare decisis. Los criterios interpretativos fundamentados en la decisión judicial han ejercido su influencia en la decisión de casos futuros a través del estudio de la ratio decidendi y de los obiter dicta. El estudio de las técnicas que flexibilizan el sistema permite la utilización de los precedentes vinculantes sin perjudicar la evolución del Derecho.Asimismo, cabe destacar la importancia de las decisiones judiciales en la familia del civil law a través de la jurisprudencia. Legal precedents play a major role in common law and, through the work carried out by the courts, it is possible to verify that court decisions have been abided by since the very beginning as a way for equality and justice to unfold. The use of legal precedents has contributed to optimising a coherent and stable system of law. The value of argumentation is highlighted, principally through stare decisis. Interpretative criteria based on court decisions have exerted their influence in the legal decision-making process of future cases by analysing the ratio decidendi and the obiter dicta. The study of the techniques that help to make the legal system flexible makes possible the use of binding precedents without harming the evolution of the Law. Moreover, noteworthy is the significance of court decisions in the civil law family through the use of doctrine. The irradiation of constitutional values, both in Spain and in Brazil, has shed light on the application of rule of law principles, equality in the application of the law and the protection of legitimate trust, all of which are interlocked in order to strengthen the need for the uniformization of doctrine and the use of mechanisms aimed at attaining this...
